FCC COVID\u201319 TELEHEALTH PROGRAM.<\/strong><\/li><li>(a) DEFINITIONS.\u2014In this section\u2014<\/li><li>(1) the term \u2018\u2018appropriate congressional com-<\/li><li>mittees\u2019\u2019 means\u2014<\/li><li>(A) the Committee on Commerce, Science,<\/li><li>and Transportation of the Senate; and<\/li><li>(B) the Committee on Energy and Com-<\/li><li>merce of the House of Representatives;<\/li><li>(2) the term \u2018\u2018Commission\u2019\u2019 means the Federal<\/li><li>Communications Commission; and<\/li><li>(3) the term \u2018\u2018COVID\u201319 Telehealth Program\u2019\u2019<\/li><li>or&nbsp;&nbsp; \u2018\u2018Program\u2019\u2019&nbsp;&nbsp;&nbsp; means&nbsp; the&nbsp;&nbsp; COVID\u201319&nbsp;&nbsp;&nbsp; Telehealth<\/li><li>Program established by the Commission under the<\/li><li>authority provided under the heading \u2018\u2018SALARIES<\/li><li>AND&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; EXPENSES\u2019\u2019&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; under&nbsp;&nbsp; the&nbsp;&nbsp; heading&nbsp;&nbsp; \u2018\u2018FEDERAL<\/li><li>COMMUNICATIONS COMMISSION\u2019\u2019 under the heading<\/li><li>\u2018\u2018INDEPENDENT AGENCIES\u2019\u2019 in title V of divi-<\/li><li>sion B of the CARES Act (Public Law 116\u2013136;<\/li><\/ul>\n\n\n\n<p>23&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 134 Stat. 531).<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>(b) ADDITIONAL APPROPRIATION.\u2014Out of amounts<\/li><li>in the Treasury not otherwise appropriated, there is ap-<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\" type=\"1\"><li>propriated&nbsp; $249,950,000&nbsp; in&nbsp;&nbsp; additional&nbsp; funds&nbsp;&nbsp; for&nbsp;&nbsp; the<\/li><li>COVID\u201319 Telehealth Program, of which $50,000 shall<\/li><li>be transferred by the Commission to the Inspector General<\/li><li>of the Commission for oversight of the COVID\u201319 Tele-<\/li><li>health Program.<\/li><li>(c) ADMINISTRATIVE PROVISIONS.\u2014<\/li><li>(1) EVALUATION OF APPLICATIONS.\u2014<\/li><li>(A) PUBLIC NOTICE.\u2014Not later than 10<\/li><li>days after the date of enactment of this Act,<\/li><li>the Commission shall issue a Public Notice es-<\/li><li>tablishing a 10-day period during which the<\/li><li>Commission will seek comments on\u2014<\/li><li>(i) the metrics the Commission should<\/li><li>use to evaluate applications for funding<\/li><li>under this section; and<\/li><li>(ii) how the Commission should treat<\/li><li>applications&nbsp;&nbsp; filed&nbsp;&nbsp;&nbsp; during&nbsp;&nbsp;&nbsp; the&nbsp;&nbsp;&nbsp; funding<\/li><li>rounds for awards from the COVID-19<\/li><li>Telehealth Program using amounts appro-<\/li><li>priated under the CARES Act (Public Law<\/li><\/ul>\n\n\n\n<p>21&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 116\u201336; 134 Stat. 281).<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>(B) CONGRESSIONAL NOTICE.\u2014After the<\/li><li>end of the comment period under subparagraph<\/li><li>(A), and not later than 15 days before the<\/li><li>Commission first commits funds under this sec-<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\" type=\"1\"><li>tion, the Commission shall provide notice to the<\/li><li>appropriate&nbsp; congressional&nbsp;&nbsp;&nbsp; committees&nbsp;&nbsp;&nbsp; of&nbsp;&nbsp; the<\/li><li>metrics the Commission plans to use to evaluate<\/li><li>applications for those funds.<\/li><li>(2) EQUITABLE DISTRIBUTION.\u2014To the extent<\/li><li>feasible, the Commission shall ensure, in providing<\/li><li>assistance under the COVID\u201319 Telehealth Program<\/li><li>from amounts made available under subsection (b),<\/li><li>that not less than 1 applicant in each of the 50<\/li><li>States and the District of Columbia has received<\/li><li>funding from the Program since the inception of the<\/li><li>Program, unless there is no such applicant eligible<\/li><li>for such assistance in a State or in the District of<\/li><li>Columbia, as the case may be.<\/li><li>(3) PREVIOUS APPLICANTS.\u2014The Commission<\/li><li>shall allow an applicant who filed an application dur-<\/li><li>ing&nbsp;&nbsp;&nbsp; the&nbsp;&nbsp;&nbsp; funding&nbsp;&nbsp; rounds&nbsp;&nbsp; for&nbsp;&nbsp;&nbsp; awards&nbsp;&nbsp; from&nbsp;&nbsp; the<\/li><li>COVID\u201319 Telehealth Program using amounts ap-<\/li><li>propriated under the CARES Act (Public Law 116-<\/li><li>36; 134 Stat. 281) the opportunity to update or<\/li><li>amend that application as necessary.<\/li><li>(4) INFORMATION.\u2014To the extent feasible, the<\/li><li>Commission shall provide each applicant for funding<\/li><li>from the COVID\u201319 Telehealth Program, if re-<\/li><li>quested, with\u2014<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\" type=\"1\"><li>(A) information on the status of the appli-<ul><li>cation; and<\/li><li>(B) a rationale for the final funding deci-<\/li><li>sion for the application, after making that deci-<\/li><li>sion.<\/li><li>(5) DENIAL.\u2014If the Commission chooses to<\/li><li>deny an application for funding from the COVID\u2013<\/li><li>19 Telehealth Program, the Commission shall\u2014<\/li><li>(A) issue notice to the applicant of the in-<\/li><li>tent of the Commission to deny the application<\/li><li>and the grounds for that decision;<\/li><li>(B) provide the applicant with 10 days to<\/li><li>submit any supplementary information that the<\/li><li>applicant determines relevant; and<\/li><li>(C) consider any supplementary informa-<\/li><li>tion submitted under subparagraph (B) in mak-<\/li><li>ing any final decision with respect to the appli-<\/li><li>cation.<\/li><li>(d) REPORT TO CONGRESS.\u2014Not later than 90 days<\/li><li>after the date of enactment of this Act, and every 30 days<\/li><li>thereafter until all funds made available under this section<\/li><li>have been expended, the Commission shall submit to the<\/li><li>appropriate congressional committees a report on the dis-<\/li><li>tribution of funds appropriated for the COVID\u201319 Tele-<\/li><li>health Program under the CARES Act (Public Law 116\u2013<\/li><\/ul><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\" type=\"1\"><li>36; 134 Stat. 281) or under this section, which shall in-<\/li><li>clude\u2014<\/li><li>(1) non-identifiable and aggregated data on de-<\/li><li>ficient and rejected applications;<\/li><li>(2) non-identifiable and aggregated data on ap-<\/li><li>plications for which no award determination was<\/li><li>made;<\/li><li>(3) information on the total number of appli-<\/li><li>cants;<\/li><li>(4) information on the total dollar amount of<\/li><li>requests for awards made under this section; and<\/li><li>(5) information on applicant outreach and tech-<\/li><li>nical assistance.<\/li><li>(e) PAPERWORK REDUCTION ACT REQUIREMENTS.\u2014<\/li><li>A collection of information conducted or sponsored under<\/li><li>any regulations required to implement this section shall<\/li><li>not constitute a collection of information for the purposes<\/li><li>of subchapter I of chapter 35 of title 44, United States<\/li><li>Code (commonly referred to as the \u2018\u2018Paperwork Reduction<\/li><\/ul>\n\n\n\n<p>20 Act\u2019\u2019).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>[dflip id=&#8221;31731&#8243;][\/dflip] SEC. 903.
